Terms & Conditions

Last updated: 30 September 2026

1. Agreement

These Terms & Conditions ("Terms") govern the provision of performance marketing services by Advera Marketing ("Advera", "we", "us", ABN 21 539 340 704) to any client who engages our services ("Client", "you"). By applying, signing a proposal, or otherwise engaging Advera, you agree to be bound by these Terms.

2. Services

Advera provides paid social and performance marketing services, including but not limited to Meta and Instagram advertising strategy, campaign setup and management, creative direction, and reporting via Advera Hub. The specific scope, deliverables, and fees for each engagement will be set out in a separate proposal, order form, or written agreement between Advera and the Client, which forms part of these Terms.

3. Client Responsibilities

The Client agrees to provide timely access to relevant ad accounts, brand assets, product information, and approvals required for Advera to perform the services. Delays in providing access or approvals may delay campaign timelines and results, and Advera is not responsible for performance impacts caused by such delays.

4. Fees & Payment

Fees for services are as set out in the applicable proposal or invoice. Unless otherwise agreed in writing, invoices are payable within 7 days of the invoice date. Advertising spend (the budget paid directly to Meta, Instagram, or other ad platforms) is separate from Advera's management fees and is the Client's responsibility unless otherwise agreed. Late payments may result in a pause of services until the account is brought current.

5. Offers

Advera may promote limited-time offers on this website for new clients, including the lead guarantee described below. Offers are promotional in nature and are provided to encourage prompt application. They do not reduce the service commitments set out in an accepted proposal.

Lead Guarantee. Where a lead guarantee applies (for example, a target of 20+ leads in a Client's first month), a "lead" means a qualifying enquiry generated through the campaigns Advera manages for the Client, as tracked via Advera Hub or another agreed reporting method. The lead target itself is not guaranteed. What is guaranteed is the remedy: if the target is not reached within the stated period, Advera will waive its management fee for the following period only. Any advertising spend incurred during that time remains the Client's responsibility unless expressly stated otherwise.

Countdown Timers. Any countdown shown on this website, including a 24-hour timer that starts from a visitor's first visit, is a promotional prompt to apply and is tracked in your browser only. It does not itself determine whether you qualify for an offer. Clearing your browser data, using a different browser, or using a different device will show a new countdown.

Eligibility. Offers are available to new clients only, are subject to Advera's assessment of fit, and apply from the date of an accepted application. Advera reserves the right to set additional eligibility criteria for, and to end, extend, or modify, any offer at its discretion.

6. Term & Termination

Engagements continue on the basis agreed in the applicable proposal (e.g. month-to-month or a fixed term). Either party may terminate an ongoing engagement by providing 30 days' written notice, unless a different notice period is agreed in writing. Fees for work performed and ad spend already committed up to the termination date remain payable.

7. No Guarantee of Results

Advera will use reasonable skill, care, and industry experience in planning and running campaigns. However, advertising performance is influenced by many factors outside Advera's control (platform algorithm changes, market conditions, competitor activity, product-market fit, pricing, and website/landing page performance, among others). Advera does not guarantee specific results, return on ad spend, lead volume, or revenue outcomes.

8. Intellectual Property

Creative assets, ad copy, and strategy documents produced by Advera specifically for the Client become the Client's property once paid for in full, except for Advera's pre-existing tools, templates, frameworks, and methodologies, which remain Advera's property and may be reused across other client engagements.

9. Confidentiality

Both parties agree to keep confidential any non-public business, financial, or strategic information shared during the engagement, and to use it only for the purpose of delivering or receiving the services.

10. Limitation of Liability

To the maximum extent permitted by law, Advera's total liability arising out of or in connection with the services is limited to the total fees paid by the Client to Advera in the three (3) months preceding the event giving rise to the claim. Advera is not liable for indirect, incidental, or consequential losses, including loss of profits or loss of data.

11. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or the services will be subject to the exclusive jurisdiction of the Australian courts.

12. Free Guides & Resources

Any free guide, report, or resource Advera makes available, including guides offered on our advertising pages, is general information only. It is not personalised advice, and downloading or reading it is not a promise of any marketing result for your business. The performance guarantees described in Section 5 apply only where you have engaged Advera under an accepted application or proposal, not merely from reading a free resource.

13. Contact

Questions about these Terms can be directed to coopsw2025@gmail.com or 0458 024 738.

This is a general template and does not constitute legal advice. We recommend having these Terms reviewed by a qualified Australian legal professional before relying on them for client engagements.
